Agreeing to these terms
By creating an account or using Mapily, you agree to these terms. If you are using
Mapily for a company or another person, you confirm you are allowed to accept
these terms on their behalf. If you do not agree, do not use the service.
Mapily is a product of Akili Tech Labs Ltd
(akililabs.org),
a company registered in England and Wales, company number 16370732. In these terms "Mapily",
"we" and "us" mean Akili Tech Labs Ltd. Our Privacy Policy forms
part of this agreement.
What Mapily does
You connect a public Instagram or TikTok account. We read the posts already
published on it, pull out the places you have named, and match each one to a real
location to build a map. You review what we found, remove anything you would
rather not include, style the map, and publish it at your own link.
Mapily reports the places you have mentioned. It does not invent places, and it
does not add anything you did not post.
Who can use it
You must be at least 16 and legally able to enter a contract. You must not use
Mapily if we have previously suspended you, or if the law where you are prohibits
it.
Your account
Give us accurate details and keep them current. You are responsible for what
happens under your account and for keeping your login secure. Tell us promptly at
hello@mapily.app if you think someone else
has access.
Your content
You keep ownership of everything you post and everything you add here.
Your posts, your pictures, your notes and your map remain yours.
So that we can actually run the service, you give us a worldwide, non-exclusive,
royalty-free licence to host, store, reproduce, adapt and display your content,
for the sole purpose of operating and improving Mapily and showing your map to the
people you share it with. "Adapt" here means the ordinary technical work of
running a map: resizing an image, generating a preview, extracting a place name.
We will not sell your content or licence it on to anyone else.
This licence lasts as long as your content is on Mapily. Delete a place, unpublish
the map, or close your account, and the licence ends for that content, apart from
backup copies that expire on our normal cycle.
You confirm that your content is yours to share and that it does not infringe
anyone else's rights or break the law.
Accuracy of places
Matching a name in a caption to a point on a map is done automatically, and it is
not perfect. A place can be matched to the wrong branch, a business can move or
close, and third-party map data can be out of date.
We show you what we found so you can check it before you publish. You are
responsible for the map you publish. Please do not rely on Mapily for anything
where being in the wrong place matters.
A pin records that you mentioned a place. It is not a recommendation or an
endorsement by Mapily, and we have no relationship with the businesses shown.
Publishing a map
A map is private until you publish it. Once published, anyone with the link can
view it, and search engines may index it. Only publish what you are happy to be
public.
You can unpublish or delete a map whenever you like and the public page stops
working. We cannot recall copies other people have already saved or that search
engines have already cached.
Acceptable use
Do not use Mapily to:
- break the law, or infringe anyone's privacy, copyright or other rights;
- publish content that is unlawful, harassing, hateful, deceptive, or that
targets or endangers a particular person;
- pin someone's home or another private location in order to expose it;
- impersonate anyone, or connect an account you have no right to;
- misrepresent a paid arrangement as an ordinary mention where the law requires
it to be disclosed;
- scrape, crawl or bulk-download Mapily, or use automated means to access it
beyond ordinary use;
- probe or interfere with our systems, or try to get around limits, security or
authentication;
- resell or redistribute the service as your own.
We may remove content or suspend an account that breaches this section.
Reporting a problem
If a map infringes your rights, misidentifies your business, or shows something
that should not be public, email
hello@mapily.app with the link and what is
wrong. We will review it, and we will remove or correct content where the report
is justified.
Plans and payment
Mapily has a free plan. Paid plans add customisation, categories and analytics,
and the price and what is included are shown when you subscribe.
Paid plans renew automatically for the same period until you cancel, and you can
cancel at any time from your account. Cancelling stops the next renewal and you
keep the paid features until the end of the period you have paid for. Fees are
exclusive of any applicable tax unless we say otherwise. If we change prices, we
will tell you before the change applies to you.
If you are a consumer in the UK or the EU you have a statutory right to cancel
within 14 days of subscribing. By starting to use a paid feature immediately you
ask us to begin straight away, and you may be charged for what you have used if
you then cancel within that period. Nothing here affects your statutory rights.
Our intellectual property
Mapily, its name, logo, software, design and documentation belong to us or our
licensors. These terms give you permission to use the service, not ownership of
any part of it. Map imagery and place data are supplied by third parties including
OpenStreetMap contributors and are subject to their own licences, which we credit
on the map.
If you send us feedback or ideas, we may use them freely and without owing you
anything.
Availability and changes
We work to keep Mapily running, but we do not promise it will be uninterrupted or
error-free. We may need to take it down for maintenance, and we may add, change or
withdraw features.
If we make a change that materially reduces what you get on a paid plan, we will
tell you, and you may cancel and receive a pro-rata refund for the unused part of
your term.
We may update these terms. If a change matters to you, we will give reasonable
notice by email or in the app before it takes effect. Continuing to use Mapily
after that means you accept the new terms.
Ending the agreement
You can stop using Mapily and delete your account at any time.
We may suspend or close your account if you materially breach these terms, if we
are required to by law, or if keeping it open would expose us or others to risk.
Except where a breach is serious or we are legally prevented, we will warn you
first and give you a chance to put it right.
When an account closes, published maps stop working and we delete your data in
line with the Privacy Policy. Sections that by their nature
should survive, including content licences for material already distributed,
intellectual property, liability and governing law, continue to apply.
Disclaimers
Except as these terms expressly say, and to the extent the law allows, Mapily is
provided "as is". We do not warrant that the service will meet your requirements,
that place matches will be accurate or complete, or that third-party platforms and
map data will remain available.
If you are a consumer, you have legal rights that we cannot exclude, including the
right to a service carried out with reasonable care and skill. Nothing here
affects those rights.
Liability
Nothing in these terms limits our liability for death or personal injury caused by
our negligence, for fraud or fraudulent misrepresentation, or for anything else
that cannot lawfully be limited.
Subject to that, we are not liable for loss of profit, loss of business,
reputational harm, or any indirect or consequential loss, and our total liability
arising out of or in connection with these terms is limited to the greater of the
amount you paid us in the 12 months before the claim, or £100.
If you are a consumer, we are responsible for loss that is a foreseeable result of
our breaking these terms or failing to use reasonable care and skill, but not for
loss that is not foreseeable, and not for losses arising from your use of Mapily
for business purposes.
General
These terms, together with the Privacy Policy, are the whole agreement between us.
If any part is found unenforceable, the rest continues to apply. If we do not
enforce something straight away, we have not given up the right to do so later.
You may not transfer your rights under these terms without our consent; we may
transfer ours if Mapily is sold or reorganised, without reducing your rights.
These terms and any dispute arising from them are governed by the law of England
and Wales, and the courts of England and Wales have exclusive jurisdiction. If you
are a consumer resident elsewhere in the UK or in the EEA, you keep the protection
of the mandatory laws of the country you live in, and you may bring proceedings
in your local courts.
